Permission and Release of Liabiliy

In consideration of Tails offering this Volunteer opportunity, I agree to the following, intending to be legally bound: 1. I/my child will abide by Tails’ mission, rules, regulations and policies. 2. If I/my child stop being a Volunteer for Tails for any reason, or upon Tails’ request at any time, I will promptly return all of Tails’ supplies, equipment, records, moneys, and other items in good, clean condition. I assume on behalf of myself/my child, the risks of being bitten, scratched, injured, or frightened by the animals in connection with my/my child’s Volunteer work for Tails and I further assume the risks of being exposed to and contracting diseases/parasitic infections which can be passed from animals to humans. Tails is not liable to me/my child for any injuries, damages, liabilities, losses, judgments, costs or expenses whatsoever, which I/my child might suffer or sustain in connection with the performance of my Volunteer activities for Tails, unless they are the result of Tails’ gross negligence or intentional misconduct. I will indemnify, defend and hold Tails harmless from and against any claims, lawsuits, injuries, damages, losses, costs or expenses whatsoever, sustained by any companion animal or any person in connection with my intentional misconduct or grossly negligent performance of Volunteer activities for Tails, or my breach of Tails’ rules, regulations, policies and programs. 4. If signing on behalf of a minor: My child, or child under my guardianship, has enough experience with dogs and/or cats and is mature enough to Volunteer with Tails and to participate in activities with the animals residing at the Tails Shelter and those animals they may come in contact with while Volunteering for Tails. 5. I understand and agree that Tails may refuse Volunteer applications for any reason. 6. I understand that Tails highly recommends that my own animals be current on routine vaccinations so that they are protected in the unlikely event that I carry a disease home with me on my clothing or on my person. 7. If I will be sheltering or providing foster care or boarding any of Tails’ animals in my home or business, I consent to Tails visiting my home or business from time to time to observe the animals and their living quarters. 8. This Permission and Release Form is binding upon me, my spouse/partner, and my and his/her respective heirs, successors, assigns, executors, and personal representatives. 9. I have accurately and truthfully completed this Volunteer Application and Agreement. 10. Any modification to this Agreement must be in writing signed by both parties. This Agreement is binding upon Tails, me, and Tails’ and my respective heirs, successors, assigns, executors, and personal representatives. 11. This Volunteer Agreement and any disputes arising there from will be governed by the laws of the State of Illinois. 12. I have had the opportunity to read this Waiver and to ask questions about it and consult with others, including my attorney, about the terms of this Waiver and I am signing this freely and voluntarily and with no duress or undue influence of any type, sort or nature whatsoever.
