Theatre for everyone: The Vancouver Fringe is a safe space for everyone who wishes to participate and take part in our wonderful community of volunteers, artists, patrons, and donors. We DO NOT tolerate harassment of any kind (including but not limited to: gender identity, race, immigration status, religion, different abilities, sexual orientation, etc). A harassment complaint will result (depending on its severity) in a reprimand and warning, or immediate termination of volunteers and/or staff.

Please note:

Volunteers have the right to remove themselves from duty, and lodge an official complaint with Festival management, when Festival staff, volunteers, or artists' behaviour is in direct contravention with any of the clauses above.

The Festival reserves the right to dismiss volunteers from duty without notice when the volunteer's behaviour is in direct contravention with any of the clauses above and/or our Code of Conduct. 

Terms and Conditions

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, INDEMNITY AGREEMENT, AND IMAGE RELEASE

(Hereinafter referred to as the “Release Agreement”)

BY ACCEPTING THIS AGREEMENT YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION

 PLEASE READ CAREFULLY!

TO: Vancouver Fringe Theatre Society and the Vancouver Fringe Festival, and their parent companies, affiliates, subsidiaries, shareholders, partners, investors, directors, officers, employees, volunteers, independent contractors, subcontractors, agents, representatives, successors and assigns (collectively, the “Releasees”).

DEFINITION

In this Release Agreement, the term “Volunteer Activities” shall include all activities, services and use of facilities provided by or arranged by the Releasees or in any way related to the Vancouver Fringe Festival, including, but not limited to: orientation and instructional sessions; transportation to and from areas used for the activities; volunteer duties; and all activities undertaken in connection with or under the name or sponsorship of Vancouver Fringe Theatre Society or the Vancouver Fringe Festival.

ASSUMPTION OF RISKS

I am aware that the Volunteer Activities may include activities that could be hazardous to me, and may put me at risk of serious injury or illness, including death. I acknowledge that these risks and dangers may arise from any number of circumstances, including those caused by physical activities which may, among other things: be performed in lighted or unlighted areas; involve various forms of equipment and staging; be carried out in indoor facilities or outdoors; involve working around special effects and obstacles, vehicular traffic, other participants, on varied terrains, and in varied weather conditions; or result from negligence of the Releasees or any other person involved with, participating in, or attending an activity undertaken in connection with or under the name or sponsorship of Vancouver Fringe Theatre Society or the Vancouver Fringe Festival .

I acknowledge that the Volunteer Activities may require physical work and I further acknowledge that I am solely responsible for ensuring that I am physically capable of performing the Volunteer Activities and for advising the Releasees of any illness or physical limitation that may prevent or limit my participation in the Volunteer Activities.

I am aware of the risks and hazards associated with the Volunteer Activities as set out above and I accept full and sole responsibility for all risks, both known and unknown, inherent or otherwise, related to my participation in the Volunteer Activities and acknowledge that I am voluntarily participating in the Volunteer Activities with full knowledge and awareness of such risks.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the Releasees permitting me to participate in the Volunteer Activities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

1. To waive any and all claims that I have, or may in the future have, against the Releasees and to release the Releasees from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in the Volunteer Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE VOLUNTEER ACTIVITIES as set out above;
2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in, or presence at, the Volunteer Activities;
3. This Release Agreement shall be binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity; and
4. This Release Agreement and any rights, duties, and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction; and any litigation involving the parties to this Release Agreement shall be brought solely within the province of British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia.

In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of the Volunteer Activities, or in any other respect, other than what is set forth in this Release Agreement.

IMAGE RELEASE

I hereby unconditionally and irrevocably consent, authorize and grant to the Releasees and their authorized representatives:

• The right to take photographs, video audio or other recordings which may capture my name, image, voice or likeness (collectively, “Images”), either individually or as part of a group, in the course of, or in relation to the Vancouver Fringe Festival or other events undertaken under the name or sponsorship of Vancouver Fringe Theatre Society or the Vancouver Fringe Festival ;

• The right to use such Images, internally or externally, for any and all purposes including, but not limited to, the marketing, promotion and hosting of the Vancouver Fringe Festival or other events undertaken under the name or sponsorship of Vancouver Fringe Theatre Society or the Vancouver Fringe Festival ; and

• The right to use, reproduce, display, distribute, and make derivative use of the Images.

I hereby unconditionally and irrevocably agree that no royalties, fees or other compensation will be payable to me or any other person in connection with such taking and use of the Images.

I further hereby release the Releasees from any and all claims which I may now or in the future have relating to ownership, use, reproduction, display, distribution or other exploitation of the Images or any materials produced by, or at the direction of, the Releasees which contain the Images.

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY CLICKING THE BOX ON THE VOLUNTEER APPLICATION STATING “I have read, understand, and agree to the terms and conditions, included in the Release Agreement” I AM WAIVING CERTAIN LEGAL RIGHT WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
