Volunteer Consent, Waiver and Release

I, as a volunteer, understand that my activities as a volunteer for Lexington Habitat for Humanity, Inc. (“LHFH”), may include, without limitation, working at construction sites; working at or in connection with ReStore operations; loading and unloading materials; demolition of existing structures; repair of existing structures; new construction; working with and near construction supplies and tools, including power tools; working on ladders and at heights; exposure to hazardous materials, including without limitation lead, asbestos, and mold; working in and near other individuals; and other related and similar activities or risks (the “Activities”).

I understand and acknowledge that by signing this Release, I voluntarily assume all risks of the Activities, both known and unknown. In the event that I am injured during participation as a volunteer, I consent to the provision of first aid treatment and, if the emergency contact below cannot be promptly contacted, authorize LHFH to act as my agent to consent to any medical treatment. In consideration for being allowed to participate as a volunteer for LHFH, I, on behalf of myself (or my dependent) and my next of kin, heirs and representatives, release from all liability, hold harmless, and covenant not to sue LHFH and its employees, officers, directors, contractors, sponsors, donors, volunteers and agents (the “Released Parties”) from any and all claims, damages, losses or liabilities of any kind, including without limitation, physical injury (including without limitation paralysis, permanent disability, and death), illness (including without limitation COVID-19), property damage, economic, psychological, or emotional loss, arising from or related to my participation in the Activities, whether or not caused by any Released Party’s negligence or fault, whether whole in or in part.

As a volunteer, I will adhere to the LHFH safety standards. I understand that I must respect the privacy of LHFH applicants, partner families, homeowners, staff, and other volunteers. I will exercise confidentiality at all times. I agree that photographs, pictures, videos, or audio recordings may be taken of me (or my dependent) as a volunteer with LHFH and grant LHFH all right, title and interest in and
to same. I acknowledge that I will have no ownership interest in or to any such images or recordings and waive and release any claim of right, publicity or compensation.

I also agree to be added to LHFH's online volunteer registration and scheduling system and to the mailing list for LHFH's electronic newsletter. I understand that I can unsubscribe at any time.

No youth under age 16 are allowed on any site when construction is being performed. All youths age 16 and 17 must be accompanied by an adult chaperone age 21 or older at all times. For every four youths age 16 or 17, there must be one adult present. Youths under age 18 may not operate power tools or work demolition, excavation or roofing.

This Waiver is valid for one (1) year. 
I understand that this document is written to be as broad and inclusive as legally permitted by the Commonwealth of Kentucky. I agree that if any portion is held invalid or unenforceable, all remaining terms will remain in full force and effect.
