Volunteer Agreement for Habitat for Humanity Kingston Limestone Region
Health & Safety Training
I, the volunteer, agree that I have completed the online Health & Safety training as part of setting up my volunteer profile. I understand the Health & Safety training is mandatory to ALL volunteers who are looking for any type of volunteering opportunities (Build Site, Office, ReStore, Events, etc.) with Habitat for Humanity Kingston Limestone Region.
RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
THIS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY (the “Release”) reviewed by the Volunteer in favour of Habitat for Humanity Kingston Limestone Region (“Habitat”), a Provincial non-profit corporation, their directors, officers, employees and agents. Minimum age for all build volunteers is 16 years old and ReStore volunteers are a minimum of 15 years of age.
The Volunteer desires to participate in the Habitat program and the activities related to the work project. The Volunteer understands that the activities may include working on build sites, working in the ReStore, various fundraising and other activities incidental to the Habitat Program. The Volunteer understands that the Habitat Program may include activities that may be hazardous to the Volunteer and that food, accommodations and medical facilities may be donated to Habitat and beyond the control of Habitat.
RELEASE: The Volunteer does hereby release and forever discharge Habitat, and successors from any and all liability, claims, causes of action and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the Volunteer’s participation in the Habitat Program.
INDEMNITY (uncountable legal insurance or protection against injury or loss): The Volunteer further agrees to indemnity and save harmless Habitat for any claim or causes of action arising by reason of the Volunteers’ participation in the Habitat Program. The Volunteer understands that this Release discharges Habitat from any liability or claim that the Volunteer may have against Habitat or with respect to any bodily injury, illness, death, property damage or any other claim that may result from the Volunteers’ participation in the Habitat Program. The Volunteer also understands that Habitat does not assume any responsibility for or obligation to provide financial or other assistance to the volunteer, including but not limited to medical, health or disability insurance. The Volunteer understands that Habitat does not carry or maintain health, medical or disability insurance coverage for any Volunteer. Such coverage should be the sole responsibility of the Volunteer.
MEDICAL TREATMENT: The Volunteer does hereby release and forever discharge Habitat from any claim whatsoever which arise or may hereafter arise on account of any first aid, treatment or service rendered in connection with the Volunteer’s participation in the Habitat program.
PHOTOGRAPHIC & MEDIA RELEASES: The Volunteer does hereby grant and convey unto Habitat all right, title, and interest in any and all photographic images, video/audio recording and media releases made by Habitat during the Habitat Program, including, but not limited to any royalties, proceeds or other benefits derived from such releases.
INDEPENDENT LEGAL ADVICE: The Volunteer acknowledges that they have been encouraged to obtain independent legal advice prior to the execution of this Release and Waiver of Liability and Indemnity and has either obtained same or chosen to waive such independent legal advice.
CONFIDENTIALITY AGREEMENT – VOLUNTEER: As a consequence of volunteering with Habitat for Humanity Kingston Limestone Region (Habitat KLR), I recognize that I may come into contact with or have possession of information which may be deemed to be of a confidential nature to Habitat KLR (including the Habitat ReStore). This information includes but is not limited to facts concerning donors, any negotiations in which Habitat KLR may be involved with on any issue, all information regarding applicants for housing, all information on selected families, and/or any other information so designated by Habitat KLR. All information which is deemed to be of a confidential nature shall not be released by me to any other party, including my family and friends.
I further recognize and agree that if I should no longer volunteer with Habitat KLR, I shall continue to hold all such information confidential and shall not divulge such information to any third party. I further recognize and agree that any failure on my part to comply may result in action against me.
IN WITNESS WHEREOF the Volunteer has executed the Release and Waiver of Liability and Indemnity and Confidentiality Agreement as of the day and year first written above.
In singing below the Volunteer acknowledges and assumes LIABILITY AND INDEMNITY including but not limited to the above.
