Hold Harmless and Indemnity Agreement
I have been assigned court-ordered community restitution hours or desire to perform community service hours in lieu of making a court-ordered payment or restitution. I understand that I have voluntarily agreed to perform court-ordered community service/restitution with the City of Scottsdale and that I am fully responsible for my own actions and my own safety and safety of those around me.
Assumption of Risk: I understand that the City of Scottsdale may assign me to perform tasks including, without limitation, cleaning equipment or facilities, moving equipment or furniture, breaking down event setups, picking up litter, interior or exterior painting, and light landscape maintenance. I understand that in performing these tasks, there may be a potential for physical injury including, without limitation, strained muscles, heat stroke, dehydration, exposure to chemicals, etc. I voluntarily accept and solely assume all risk of damages and injury incurred or suffered by me while participating in this program.
Release and Indemnity: I agree that in consideration of the City of Scottsdale allowing me to perform court-appointed community restitution hours within and for the City of Scottsdale, on behalf of myself and on behalf of my survivors, as applicable, I hereby waive, release, indemnify, and agree to hold harmless the City of Scottsdale, its appointed officials, officers, directors, commissioners, agents, employees, volunteers, representatives, successors, and assigns, to the fullest extent allowed by law, from and against any and all claims, suits, actions, expenses, judgments, and damages, without limitation for personal or bodily injury, wrongful death, and property damage occurring, arising from or out of, or related to or resulting from my participation in this program. I agree not to seek contribution or indemnification from the City of Scottsdale, its appointed officials, officers, directors, commissioners, agents, employees, volunteers, representatives, successors, and assigns, if I am sued by any party in connection with my participation in the court-ordered community service activity.
Tools and Equipment Release and Indemnity: In consideration of the City of Scottsdale making its tools and/or equipment available for my use, I agree to release, indemnify, and agree to hold harmless the City of Scottsdale, its appointed officials, officers, directors, commissioners, agents, employees, volunteers, representatives, successors, and assigns from all liability, including claims or actions for physical injury, death, or property damage arising out of or in connection with the borrowed tool(s) and equipment, including those claims based on product liability or negligence. I agree to waive any and all claims that I may have against the City of Scottsdale, its appointed officials, officers, directors, commissioners, agents, employees, volunteers, representatives, successors, and assigns for any physical injury, death, or property damage I experience arising out of the use of the borrowed tool(s) and equipment, including claims based in negligence. It is my responsibility to check and inspect the equipment prior to use and to stop using the tools and/or equipment if I have any indication that it might be unsafe. I agree to notify the City of Scottsdale of any problems encountered when using the tools or equipment.
Medical Assistance: I hereby authorize City of Scottsdale staff to obtain any needed medical assistance for me in case of an emergency, illness, or accident and to take me to the nearest available medical facility. I understand that any resulting expenses or charges are my responsibility, and I will pay them immediately, either directly or through personal insurance.
Media Consent: I hereby grant permission to the City of Scottsdale the right to use my name, photograph, image, likeness, or recording while participating in this court-ordered community service activity, on informational and promotional materials and reports, in printed, video, and electronic (web) form, without any obligation or liability to the City.
Disclaimer of Workers’ Compensation Benefits: I understand and expressly affirm that in performing this work, I will not be paid for my services and that I am not an employee or volunteer of the City of Scottsdale and am not entitled to receive workers’ compensation or other employee or volunteer benefits from the City of Scottsdale.
Background Check Acknowledgement: I acknowledge that the city will request a criminal history report by performing a background screening before approving my participation in the city's court-appointed community restitution program.
Additional Acknowledgments: I understand that my work schedule may be changed at the sole discretion of the City of Scottsdale and that either the City of Scottsdale or I may terminate my participation at any time for any reason. I understand that by acknowledging this waiver, I am giving up my right to sue the City of Scottsdale for any damages resulting from my participation in the court-ordered community service activity. I have carefully read all of statements above and fully understand their contents, and I am aware that this is a release of certain rights, and I sign this waiver and release of my own free will.
