Mounts Botanical Volunteer Agreement

As a volunteer at Mounts Botanical Garden, I agree to the below terms.

Volunteer, agrees that it shall hold the Palm Beach County, Palm Beach County Extension Service, and The Friends of the Mounts Botanical Garden, harmless from all claims, including injury/claim that might incur while performing in a volunteer capacity at Mounts Botanical Garden, conduct or management of the facility, ground or contents (including damage or theft to property) that may arise by reason of any negligence on the part of the Volunteer, and its officers, employees or agents, in the use by the Volunteer of any facilities owned by Palm Beach County, Palm Beach County Extension Service, or The Friends of the Mounts Botanical Garden; and in case any action is brought therefore against Palm Beach County, Palm Beach County Extension Service, or The Friends of the Mounts Botanical Garden or any of its officers, employees or agents, the Volunteer shall assume full responsibility for the legal defense thereof, and upon its failure to do so on proper notice, Palm Beach County, Palm Beach County Extension Service, or The Friends of the Mounts Botanical Garden reserves the right to defend such action and to charge all costs, including attorney's fees, to the Volunteer.

Volunteer agrees to indemnify and hold harmless the Palm Beach County, Palm Beach County Extension Service, and The Friends of the Mounts Botanical Garden and its elected officials, employees, agents, and director and each of them from and against any and all claims, liabilities, damages, losses, and expenses (including attorney fees and costs), and bodily injury incurred or sustained by any party, including any third or other party whomsoever arising from use of the Facility, and/or the Facility grounds or contents, by the Volunteer and its officials, employees, agents, and invitees, including but not limited to damage to or theft of Volunteer property.

Volunteer acknowledges the risk of Covid-19 associated with entering a public place and hereby hold Palm Beach County and Friends of the Mounts Botanical Gardens harmless if I, a friend or family member contracts Covid-19.
